  1. General conditions of use of the website www.livingbilliard.it

2.1 Access to, consultation and use of the Site www.livingbilliard.it are subject to these general terms and conditions of use (hereinafter, “GTU”) which, supplemented by any legal notices or notices published on the Site or referred to through linking links, including information relating to the Privacy Policy and the use of cookies, govern access to and use of the Site in each of its sections and parts. By using the Site, the User expresses by conclusive facts his or her full acceptance of the TOU.

2.2 Norditalia Ricambi reserves the right to update and modify, in whole or in part and at any time, the GTU as well as any additions referred to therein, including the Privacy Policy. The User is therefore invited to periodically review them, since the contents, as modified, will be effective from the moment of their publication on the Site and will be understood to be known by the User from the first access to the Site following publication.

  1. Site content and terms of use

3.1 The Site, with free access, free of charge and without registration, is intended to present to the User, for information purposes only, the products marketed by Norditalia Ricambi, without this constituting a proposal for sale.

It is Norditalia Ricambi’s goal to publish complete, correct and up-to-date information on the Site; however, due to the merely informative nature of the Site’s contents, Norditalia Ricambi does not guarantee the completeness, accuracy or timeliness of the information published on the Site, nor does it assume any responsibility for any errors or omissions.

3.2 The access and use of the Site by the User, the viewing of the pages, the sending of communications to Norditalia Ricambi, the access to other sites or platforms through links or referrals and any other activity on or by means of the Site, expresses by conclusive facts the full acceptance of the GTU by the User, including the Privacy Policy.

Should you use the Site on behalf of a Third Party, by agreeing to the TOU you represent that you have the power to represent and obligate the Third Party for this purpose.

3.3 Norditalia Ricambi and the User are mutually autonomous and independent subjects. The use of the services offered by Norditalia Ricambi on or through the Site does not determine the establishment of any different relationship other than the use of said services.

  1. Third-party content and hyperlinks

4.1 The Site may include or contain hypertext links to Internet Sites of third parties. Norditalia Ricambi does not control or perform any type of monitoring activity on such sites and their contents, regarding which it cannot be held responsible in any way.

The User who decides to access the contents of said Sites is required to check their terms and conditions of use and Privacy Policy and assumes the burden of all appropriate verification and precautions as well as any resulting liability.

4.2 Norditalia Ricambi does not allow the creation of hyperlinks to the Site without prior and express agreement in writing.

  1. Suspension of services

5.1 Norditalia Ricambi has the right to temporarily or permanently suspend access to the Site for any reason or cause whatsoever; in the event, the User shall have no claim for any reason or title whatsoever.

5.2 In the event of temporary suspension of access to the Site for improvement, repair, maintenance and restyling, the operation of the Site will resume and continue, at the end of the suspension. In any case, Norditalia Ricambi is not responsible for any damage that may result to the User from interruptions, suspensions, anomalies in the provision of service access to the Site.

  1. Privacy and Cookie Policy

6.1 Norditalia Ricambi invites the User who accesses and uses the Site, in any of its sections or parts, to carefully read the Privacy Policy to understand how Norditalia Ricambi, through the Site, collects and uses the User’s personal data and for what purposes.

6.2 By using the Site, it is possible that cookies may be set in the User’s browser. Cookies do not identify the User but may record information regarding navigation on the Site. Norditalia Ricambi invites the User accessing the Site to carefully read the Cookie Policy to understand how Norditalia Ricambi, through the Site, collects and uses the User’s personal data and for what purposes.

6.3 The Site also contains social network link buttons, which allow the User to access the pages of Norditalia Ricambi present on said social networks and to share contents. Since sharing requires the use of external scripts, Norditalia Ricambi warns the User that said third-party Sites may collect information regarding browsing habits and invites the User to carefully read the terms of use and disclosures of said Sites.

  1. Intellectual Property Rights

7.1 All content published and present on the Site, in any format, including, without limitation, layout, Site design, pages, graphics, colors, text, names, trademarks, logos, trade names, photographs, images, videos, graphic designs, icons, drawings, sounds, and HTLM codes, collectively referred to as “Content,” are protected by copyright, constituting the intellectual and industrial property of the Site Owner or of Third Parties from whom the Owner has obtained authorizations for publication.

7.2 Reproduction, in whole or in part, of the Site and its Content without the written consent of the Owner is prohibited. The User is only permitted on a temporary, non-exclusive and non-transferable basis to use the Content online, without profit or gain.

Trademarks, logos, trade names and product names on the Site may not be used in any way by the User or third parties without the prior written consent of the Owner.

7.3 The User is only authorized to view the Site and its Contents, as well as to browse the Site and to use the services offered by Norditalia Ricambi on or through the Site, in any of its sections or parts, making lawful use of the Site and its Contents. In particular, without the express authorization of the Owner it is forbidden to use, publish or send parts of the contents of the Site on other Sites or on any other means of communication open to the public.

  1. Limitations of liability

8.1 By accessing the Site, the User shall be solely responsible for the use of the Site, in each of its sections and parts, and its contents. Norditalia Ricambi shall in no way be held liable for any use, if any, by the User of the Site and its contents that is not in compliance with applicable laws.

8.2 Norditalia Ricambi shall in no way be held liable for any damage to the User’s systems or software, as well as for any loss of data resulting from or caused by any download operations performed by the User.

8.3 Norditalia Ricambi may not, moreover, be held liable in any way for any damages caused by the inability to access the services offered on or through the Site, as well as for any damages caused by viruses, malware, corrupted files, errors, omissions, service interruptions, deletion of content, problems related to the network, suppliers, devices used by the User, unauthorized access, alteration of data by third parties, erroneous operations by the User.

  1. Final Provisions

9.1 Should any one or more of the provisions set forth in these TOU be declared, in whole or in part, invalid or ineffective, it shall be deemed severable from the others and shall not affect the validity and effectiveness of the other TOU, as well as of any notices, legal notices, contractual or even informational content published in the various sections and parts of the Site, or referred to through linking links, including information relating to Privacy and Cookie Policy.

9.2 Any forbearance by Norditalia Ricambi of User conduct in violation of the TOU shall not constitute a waiver of the rights arising from the violated provisions nor of any right or faculty arising by Law or contract.

  1. Applicable law and dispute resolution

The GTU, as well as the Contents of the Site, are governed by Italian Law. In the event of a dispute, we invite the User to contact Norditalia Ricambi at the contact details indicated on the Site in order to settle the matter amicably. In the impossibility of an amicable solution, as of now Norditalia Ricambi manifests its adherence to the conciliation service “Risolvionline”, provided by the Chamber of Arbitration of Milan, and better described on the site “www.risolvionline.com“ to which reference is made.
